These Terms and Conditions ("Terms") govern your access to and use of all services provided by RoadAware Driving School Inc. ("RoadAware", "we", "us", or "our"), including but not limited to our website located at www.roadaware.net, in-car driving lessons, educational content, and package offerings (collectively, the "Services"). By enrolling in a course, booking lessons, or using our website, you agree to abide by these Terms in full. Please read carefully.
1. General Terms of Service
1.1. By using our Services, you confirm that you are at least 16 years of age and legally eligible to enroll in driving lessons in the province of Ontario or the applicable jurisdiction.
1.2. You agree to provide accurate and complete personal information when registering with RoadAware. Any misuse, false information, or impersonation may result in termination of your access to our Services.
1.3. All students must comply with the local Ministry of Transportation rules and regulations while participating in driving lessons.
2. Course Package Validity & Expiry
2.1. All course packages, lesson bundles, and in-car driving services purchased from RoadAware Driving School Inc. are valid for one (1) calendar year from the original order or purchase date.
2.2. Students are responsible for completing their entire program, including both in-class or online components and in-car sessions, within this 12-month period. After 12 months, any unused sessions or incomplete course components will be considered expired and cannot be redeemed, rebooked, or refunded.
2.3. RoadAware will not issue refunds or extensions for expired packages under any circumstances, including but not limited to changes in schedule, lack of availability, relocation, or personal time constraints.
2.4. It is the student’s responsibility to manage their bookings, track their progress, and ensure all sessions are completed within the allowed timeframe.
3. Scheduling, Cancellation & No-Show Policy
3.1. Students must schedule driving lessons through the RoadAware booking system or with an authorized instructor. Availability is not guaranteed and depends on instructor schedules, road test locations, and seasonal demand.
3.2. A minimum of 24 hours’ notice is required for cancellation or rescheduling of any in-car lesson. Failure to provide adequate notice will result in forfeiture of that session.
3.3. If a student fails to attend a scheduled lesson without notice ("no-show"), the session will be marked as completed and cannot be rebooked or refunded.
3.4. Repeated cancellations, late arrivals, or disruptive behavior may result in temporary suspension or full termination of services without refund.
4. Code of Conduct
4.1. All students are expected to conduct themselves professionally and respectfully toward instructors and staff at all times.
4.2. Any behavior that is deemed dangerous, inappropriate, harassing, or abusive may result in immediate dismissal from the program with no refund or credit.
4.3. Students must follow all instructions provided by their instructors, obey traffic laws, and demonstrate a commitment to safe driving practices.
5. Payments, Refunds, and Pricing
5.1. All prices listed on our website or provided through our services are subject to change without notice.
5.2. Full payment is required at the time of booking a package or lesson unless otherwise specified in writing by RoadAware management.
5.3. All purchases are non-refundable. Refunds will not be granted for unused, partially used, or expired packages.
5.4. In rare cases of documented medical emergencies or extenuating circumstances, RoadAware may review refund or credit requests on a case-by-case basis, but is not obligated to approve them.
6. Road Tests and Certification
6.1. Booking of road tests is the responsibility of the student unless explicitly included in the package. RoadAware instructors can provide guidance, but we are not responsible for availability or outcomes of government road tests.
6.2. Upon completion of all course requirements, students will receive certification or documentation as required under MTO regulations, provided all conditions are met.
7. Limitation of Liability
7.1. RoadAware Driving School Inc. and its instructors are not liable for any damage, injury, accident, or loss sustained by students during or after the training period.
7.2. RoadAware shall not be held responsible for missed deadlines, MTO processing delays, or road test availability issues caused by third parties.
7.3. While we strive to provide the highest quality driver education, we make no guarantee that a student will pass their road test or obtain a driver’s license.
8. Modifications to Terms
8.1. RoadAware Driving School Inc. reserves the right to modify or update these Terms at any time without prior notice. Continued use of the Services after such changes constitutes your agreement to the revised Terms.
8.2. We encourage all users to periodically review this page for any updates.
9. Governing Law
9.1. These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada.
9.2. Any disputes arising under or related to these Terms will be subject to the exclusive jurisdiction of the courts in Ontario.
